Thank you for visiting www.desireprint.in (“Site”). Please read these General Terms and Conditions (“Terms”) carefully. In these Terms, the terms “you” and “your” refer to the user or viewer of the Site, while “The Desire Print”, “we”, “our”, and “us” refer to the owner and operator of this website. These Terms govern your access and use of this Site and its services.

By accessing and/or using this Site, you confirm that you are legally competent to enter into a contract under applicable laws and agree to be bound by these Terms, along with any additional guidelines or rules that may be posted on specific pages of the Site. All such additional rules or policies are considered part of these Terms.

The Desire Print reserves the right to modify, update, or change these Terms at any time without prior notice. Any updated Terms will take effect immediately upon being posted on the Site. Continued use of the Site following any changes constitutes your acceptance of those changes.

We may provide important communications, legal notices, and updates electronically—either by posting them on the Site or sending them to the email address you provided during registration. You may withdraw consent to electronic communications, but doing so means you must discontinue your use of the Site.

Eligibility to Use

Use of this Site is available only to individuals who are legally capable of entering into binding contracts under the Indian Contract Act, 1872. Individuals who are considered “incompetent to contract,” such as minors or un-discharged insolvents, are not eligible to use this Site.

If a minor wishes to use or make a purchase from the Site, it must be done through a legal guardian or parent.

By accepting these Terms and using the Site, you confirm that you are at least 18 years old, of sound mind, and legally permitted to enter a binding contract.

Intellectual Property Rights

All content on this Site—such as images, graphics, fonts, videos, design tools, text, and templates—(collectively, “The Desire Print Content”) is the intellectual property of The Desire Print or its content providers and licensors. All rights are reserved worldwide.

You are not permitted to sell, license, modify, copy, reproduce, publish, or distribute any of The Desire Print Content, except as explicitly allowed by these Terms. We may modify, add, or remove any part of the content at any time, and we are not responsible for any loss of saved designs or user-generated content that may result.

Use of our design tools and templates does not grant exclusive rights over any design or combination of elements. Other customers may create similar or identical designs using the same tools. We do not guarantee exclusivity or legal protection of any designs made using our services.

It is solely your responsibility to ensure that the content or designs you upload or create do not infringe on the rights of any third party. The Desire Print is not liable for any such violations.

Use of Site

To place an order or use certain features, you may need to create an account on The Desire Print. By creating an account and agreeing to these Terms, you are granted permission to use the Site and its tools for the sole purpose of designing and ordering products from The Desire Print.

You are not authorized to download or distribute any part of the Site or its content beyond the final product purchased.

You confirm that any text, images, trademarks, or copyrighted content used in your orders are either owned by you or you have obtained permission to use them. You are fully responsible for the legality of the content you submit.

You must not upload or submit content that is unlawful, defamatory, offensive, infringing, or otherwise objectionable. We reserve the right to refuse or cancel any orders or remove content that violates these Terms without prior notice.

Any product displaying prohibited or legally sensitive content—such as emblems, political affiliations, or misleading representations—will not be processed. You are solely responsible for the consequences of such content.

Content and User Responsibility

You are solely responsible for any content uploaded or submitted by you (“User Content”) and how you use The Desire Print’s tools and services. We do not guarantee or verify the legality or originality of your content. You agree to release us from any liability related to your User Content or its use in your ordered products.

In case of suspected unlawful activity or content violations, The Desire Print reserves the right to report such activity to law enforcement or regulatory authorities and disclose your information if required.

Taxes

You agree to pay GST or other similar taxes, whether international, national, state, or local, as levied or imposed on any Product ordered through the Site. You are also responsible for any associated fees, including attorney and collection fees, that DesirePrint may incur in its efforts to collect any remaining balances due. This clause does not limit other remedies available to DesirePrint at law or in equity.

You agree to provide your GST registration number and Entity Name, if applicable, which must match the billing address provided. Changes to this information cannot be made after the order is placed.

DesirePrint is not responsible for verifying your GST registration number or Entity Name. Any tax liabilities resulting from non-compliance or incorrect details provided by you will be your responsibility. If you fail to provide a GST registration number, you will be treated as “unregistered” and may not be able to avail of input tax credits. It is your responsibility to assess any tax liabilities in such cases.

The liability of DesirePrint under GST will be limited to the amount of tax charged.

Shipping and Delivery

Products purchased from the Site will be delivered through DesirePrint’s logistics partner.

While DesirePrint will make efforts to deliver products by the estimated arrival date provided at the time of purchase, it cannot be held liable for any delivery delays, regardless of the cause. The Estimated Arrival Date is subject to change based on circumstances after the order is placed. DesirePrint is not responsible for damages or delays caused by factors outside of our control, such as weather, flight delays, political disruptions, or other unforeseen circumstances. A delay due to any of these factors will not be considered a deficiency in service.

You are required to provide an accurate postal address. Inaccurate or incomplete details may lead to delays or loss of shipment. DesirePrint will not be held liable for delays or losses due to incorrect addresses.

If a delivery is not completed due to an address issue or refusal to accept delivery, DesirePrint may dispose of the product after 7 days. DesirePrint is not responsible for any misuse of the product after disposal.

Cash on Delivery (COD)

COD is available for select pin codes only. If your pin code is serviceable, you can pay by cash or card at the time of delivery (subject to the logistics partner’s acceptance).

You will need to pay the amount as shown on the shipping label. In cases of split shipments or order consolidation, any discrepancies in the shipping label and product delivered will be handled via a refund for excess payments.

By selecting COD, you agree to pay the order amount upon delivery. DesirePrint reserves the right to take necessary actions, including account suspension, in case of non-payment.

Pricing Policy

Prices, fees, discounts, and promotions on the Site are subject to change. The price for a Product will be the one in effect when the order is placed, and price changes will only apply to future orders. DesirePrint is not liable for price fluctuations.

Product Quality Issues

Any issues with products must be reported to DesirePrint’s customer care within 15 days of receiving the product. Claims after this period may be denied.

Transfer of Title

The risk of loss and title for any printed product transfers to you once it is delivered to the carrier. For electronic products, delivery is considered complete when the product is emailed or made available for download on the Site.

Indemnification

You agree to indemnify DesirePrint, its affiliates, directors, employees, and agents against any claims, damages, costs, and legal fees arising from your breach of these Terms or any materials you upload to the Site.

Disclaimer of Warranty

The Site and DesirePrint content are provided “as is,” without warranties of any kind. DesirePrint does not guarantee that the Site will be uninterrupted or error-free. Product descriptions may not always be accurate, and DesirePrint is not liable for errors in uploaded content or design mistakes made by users.

Limitation of Liability

DesirePrint and its affiliates are not liable for any indirect, incidental, or consequential damages. Liability for any claim related to the Site or its content will be limited to the amount paid for the product or service in question.

Site Feedback

Any feedback you provide about the Site or products will become the exclusive property of DesirePrint. You agree that DesirePrint may use your feedback without any restrictions.

Dispute Resolution

In case of any disputes, DesirePrint will attempt to resolve matters amicably. If not resolved within 30 days, legal proceedings may be initiated in Anantapur, Andhra Pradesh, under Indian law.

Governing Law

These Terms are governed by Indian law. Any disputes will be subject to the exclusive jurisdiction of courts in Anantapur, Andhra Pradesh.
